What is a Lasting Power of Attorney?

A Lasting Power of Attorney is a legal document that allows you to appoint an attorney to make decisions on your behalf if you lose mental capacity or are no longer able to manage your affairs independently.

Many people assume their spouse, children or next of kin can automatically make decisions for them. In reality, this is not always the case. Without an LPA in place, loved ones may need to apply to the Court of Protection for authority to act, which can be stressful, costly and time-consuming.

There are two types of Lasting Power of Attorney in England & Wales:

Property & Financial Affairs LPA

This type of power of attorney allows your chosen attorney to manage financial matters on your behalf, including:

  • Paying bills

  • Managing bank accounts

  • Handling investments

  • Dealing with pensions

  • Selling or managing property

  • Managing tax affairs

This LPA can be used while you still have mental capacity if you choose.

Health & Welfare LPA

A Health & Welfare LPA allows your attorney to make decisions relating to:

  • Medical treatment

  • Care arrangements

  • Daily routines

  • Living arrangements

  • Life-sustaining treatment decisions

This type of LPA can only be used once mental capacity has been lost.

Both forms of LPA are important tools for protecting your wishes and helping your loved ones avoid unnecessary legal difficulties later on.

Why Setting Up An LPA Matters

Creating a Lasting Power of Attorney is not just for elderly individuals. Serious illness, accidents or unexpected changes in health can happen at any stage of life.

Having an LPA in place can help:

  • Ensure decisions are made by someone you trust

  • Avoid delays caused by Court of Protection applications

  • Reduce stress for your family

  • Protect your financial affairs

  • Maintain control over future healthcare decisions

  • Provide reassurance for loved ones

  • Support long-term estate & wealth planning

Without a registered LPA, even close family members may struggle to access accounts, manage property or make important healthcare decisions on your behalf.

For many clients, an LPA forms part of wider future planning alongside Will writing services, Estate Planning Trusts and Lifetime Inheritance Tax Planning.
